Lettings law is changing. Are you ready?
With all the changes to landlord legislation announced by the Government, the burden of letting property has never been so high. And if you get it wrong, the penalties are even more severe.
- No fault possession (Section 21) notices are to be abolished.
- Fixed term tenancies will no longer be allowed, and a tenancy will only end if a tenant serves notice or a landlord has a valid reason, which will be defined in law.
- A landlord’s ombudsman is to be created allowing tenants to raise complaints, with the spectre of fixed penalty notices or even expulsions from the sector for landlords.
- Rent reviews and rent increases are set to become harder to implement, with tenants given more power to challenge these changes.
- Tenants will have the right to have pets which the landlord cannot unreasonably refuse, impacting wear and tear and increasing the need for regular inspections.
- All rented homes must have a carbon monoxide detector in every room with a fixed combustion appliance. Landlord’s will be liable if they fail, with the possibility of manslaughter charges being made should the worst happen.
- Properties currently need to be rated E for energy efficiency, but this is expected to be raised to C by 2025.
- You are required to handle your tenant’s data in accordance with GDPR legislation and may need to register with the Information Commissioner’s Office.
- With the introduction of the Decent Homes Standard landlords will be subject to Ofsted-style inspections, with the prospect of unlimited fines for properties that don’t meet criteria.
- Tenants will now be able to rate their landlord – and name and shame - as part of new satisfaction measures.
